@floridadivorcelawyer: One of the biggest misconceptions in Florida divorce is that the spouse who earns more automatically has to pay the other person's attorney's fees. That's not how the law works. Under Florida Statute 61.16, the court looks at both parties' financial situations to determine whether one spouse has a financial need and whether the other has the ability to contribute. Even then, attorney's fees are not automatic. Unless both parties agree, a judge must make that decision. Every case is different, and the outcome depends on the specific financial circumstances involved. If you're facing a divorce in Florida and have questions about attorney's fees or your rights, schedule a consultation to discuss your situation.
The problem is this … when you are getting divorced bc the other person refuses to work —- it’s ridiculous that you are forced to pay their atty fees. This is very different than when there was agreement that one would stay home and raise kids. Absolutely unfair to make the rule apply to both scenarios .

What if you’re forced to drain your savings as a stay at home Mom? So you technically have the ability, but it’s not replenishable?
