@lylewhatchamacallit: So apparently I’m “illegally” living in my own home. 😅 I’m asserting succession rights to my NYC apartment, and now I’m trying to figure out what happens next. #nycapartment #nycrentals #landlordproblems #livinginnyc #knowyourrights

You had to have been living there for 2 yrs before the person died/left and you need to be a qualifying family member - if that’s not the case - no succession rights

Do not leave. He has no right. I've been working in this field for over 25 years.. The NYPD can't kick you out either. Succession rights are for members of a household that can prove occupancy for 2 consecutive years. Paystubs, w2s, bank statements, cell phone bills, can all be used as proof. There needs to be an "inquest" conducted by a judge at the housing court. Your landlord can not just kick you out. Next time he shows up YOU call the police if for nothing else to document the harassment. Message me if you need help. No strings attached

Did you notify the landlord during the tenancy of your family member that you are residing in the apartment.

you have to be a qualified family member to succeed an apartment. You need documentation proving you have been there and proving your relationship. Non traditional relationships have a chance also but if you can’t produce the paperwork you’re basically squatting.

You have rights. Get a lawyer. I found one for my disabled sister through legal mobilization. She now has her lease.

In 2026, it’s an ignorant argument on his part because deregulation ended in 2019, so it’s not like he can deregulate it. The rent for the next person would be similar to the last. He’s probably cheating other people then. Speak to your neighbors, ask if they are rent stabilized. If any of them ask, ask when they moved in. My guess is he’s illegally deregulating units.

I don’t completely know about succession rights but no matter what they have to take you through the courts to evict you. They can’t just kick you out. Call 311 and say you’re having issues with your landlord

He would have to start the eviction process. Tell him to get out or you will call the police. In each NYC housing court there is free legal advice. You can go any day of the week. They are busy. I would be in line at 8 so you get in when they open. You are a tenant.

There is no such thing. You cannot pass down rent stabilization, and they changed the law with rent controlled apartments. They can no longer be passed down through tenancy.

In order to gain succession rights you have to had been at the apartment for two years before the person pass or vacated. You have to also provide documents showing you have been there for those two years. Also have to prove relationship. You then have to send a notarized letter requesting succession rights. They are then suppose to give you an application

as long as you pay your rent you can stay there. that's your home. the landlord is trespassing at this pt if you don't want him to be there. call the cops and file charges and then take him to court for harassment. you have a "quiet enjoyment" if your living space. attorney general Leticia James' website has nyc tenant guide. you should read it and know your rights . don't let this bully of a landlord intimidate you.

You need proof you've been on the lease before she passed and it must be a year or more. Thats pretty much it to win your case against this landlord.
