in my opinion no charges should have been filed because the victim willingly got too close to an area where there would have been a strike towards the pinata that they could not see. the accident that led to the fatality was purely an accident brought on by the victim and no one else. it's like a person standing on a train track expecting the train not to hit them simply because they're there then charging the conductor for manslaughter because he can't stop the train.
