Kurt Burnstick, the former chief of Alexander First Nation in Alberta, was found by the Canadian Human Rights Tribunal to have sexually harassed former Nation employee. The tribunal concluded that Burnstick engaged in a pattern of unsolicited flirtatious and sexual behaviour toward the victim between 2000 and 2016. The conduct included kissing her without consent at a pub in 2006, repeatedly “belly bumping” her and requiring her to collect her paycheques directly from him so he could get her alone. The victim was not awarded additional financial compensation because she had previously reached a private settlement with Alexander First Nation. The tribunal applied the civil standard of proof, known as a balance of probabilities, when reaching its findings. Burnstick was previously acquitted of separate criminal charges in 2017 and 2018 after judges found insufficient evidence to prove guilt beyond a reasonable doubt.
