Hence the separation of powers and the judicial independence based upon constitutional norms. He did not advocate for anarchy but rather a system untethered to the elite. Enforceable laws are necessary for the free exchange of goods and services in a market system. Who will toil and build and create if another can come along and steal it? Even in medieval times, who would clear a field, and plant and harvest crops without protection from barbarians? Laws come first, not second.

I feel like the alternative is WAY worse. And honestly, my guess is the first “legal” system came about when people were tired of having biggest and strongest guys just taking what they wanted and beating up anyone who tried to stop them (like pretty much every other species on earth.)
