lThe Brandon Dotson case in Alabama is why I keep raising the issue of retained body parts. His family requested a second autopsy, and the independent pathologist discovered his heart was missing, which later became part of a federal lawsuit. I'm NOT saying Nolan's case is the same. I'm saying it demonstrates why questions about retained body parts and access to evidence can become relevant beyond simply being an issue between two medical examiners. Now bring that back to Nolan. I agree the first autopsy can only happen once. My point is the circumstances surrounding the retention of Nolan's neck, lungs and other structures. Even if it is LEGALLY permitted for the ME to retain or withhold those parts, that doesn't make the circumstances surrounding them irrelevant evidence. Why were they retained? What was examined? What did it show? What was available to the independent examiner? JUST BECAUSE THE FIRST AUTOPSY IS COMPLETE — OR BECAUSE SOMETHING IS LEGALLY PERMITTED — DOESN'T MAKE THE QUESTIONS DISAPPEAR. I'm not saying retained body parts prove homicide. I'm not saying the second examination overrides the first. And I'm not asking the public to have the evidence. I'm saying these are questions about evidence. If this case is going before a grand jury, then shouldn't the relevant facts surrounding both examinations be considered — what was retained, why it was retained, what testing was done, the results, what was available to the independent examiner, and any unanswered questions? I'm not asking the grand jury to find anyone guilty. I'm saying the relevant evidence should be before the appropriate authorities so they can determine whether further investigation or charges are warranted. If the evidence establishes drowning, let it establish drowning. If it establishes something else, let it establish that. Justice isn't deciding who is guilty before the evidence is complete. Justice is following the evidence wherever it leads. Justice for Nolan. Justice for every child. And due process for everyone involved.
