“Do they deserve it” is a way of blaming others for your actions. It’s not about what they deserve, it’s about who you want to be.

We saw recently adults calling for children to be incarcerated because the crime was disturbing and harmful, even after a judge ruled the offenders behavior wouldn’t be helped and actually made worse by imprisonment. They are now in prison because they simply “deserve it” when the appeal changed the decision to appease public desire for revenge. Criminal punishment should be based on what reducing harm within society, and if rehabilitation of child offenders can be achieved outside of prison, then they should be the sentence:

Its backwards thinking, when you ask "What do they deserve" you're looking at the past to make a decision in the present. What people should do is look at the future and figure out wht decision would lead to the best outcome possible. But human emotions always overpower human rationality.

Also if we're talking about society: punishment doesn't make you safer. punishment happens AFTER the crimes and there's lots of evidence that shows harsher punishments don't reduce crimes. what does make an impact is fighting the root causes. (poverty in most cases). punishment is irrelevant in creating a good, safe society

You make a great argument against the notion of just deserts. I would go even further and argue that the notion is semantically undisciplined or even meaningless. I have spelled out this entire argument elsewhere, but the short version is that is only has meaning in the context of authoritarian frameworks. Its development seems to go from our experience of (most) parenting, through (some) god-based religious narratives, and finally into politics and day to day life. All of these indoctrinate us with ideas of punishment and reward. Our minds are desperate to resolve the inevitable cognitive dissonance and so our brains find a (local) minimum of anxiety in the conclusion that we “deserved” this or they “deserved” that. But that isn’t how the real world works. It’s a narrative invention. And a deeply destructive one.

After what happened to Jason Arday yesterday, I sadly feel this is even more relevant. It’s very easy to engage in righteous cruelty against a “deserving” person. We need to be very careful about what many small individual acts of cruelty result in. It’s so overwhelming to be on the other side of it all, especially the scale at which happened here. It’s really sad, as soon as I saw the news I thought about your videos on this topic again.

I would go as far as to say, if one has very strict rules and punishments guiding behaviours of others, we would justly call this person ruthless, dictatorial or even immorally strict. One having very strict rules towards themselves regardless of others would be considered principled, moral and a good person. It might be my anarchist roots and readings that guided me to this idea though.

I had a discussion with someone about the justice system. If a murderer is on trial, would you be willing to give that murderer 1 million dollars, flowers, and anything else, if it meant that crime goes down compare to punishment.

Navel gazing is fine but free societies require that we answer questions that directly affect others. Including punishments. Not everyone is comfortable with that, and lack the stomach for the less pleasant parts of adult life. It’s fine to abstain if this is so.
