@mistithorpe: LINDSAY CLANCY TRIAL — I found myself incredibly frustrated watching the cross-examination of Dr. Jennifer Tufts today. Not because I think Dr. Tufts should be above criticism. Question her decisions. Question her experience. Question whether she missed warning signs. But give the jury the CONTEXT necessary to understand her answers. The aggressive, rapid-fire questioning today felt like it was creating a very specific picture: “You didn’t call the hospital?” “No.” “You didn’t call her husband?” “No.” “You didn’t call her parents?” “No.” “You didn’t know this happened?” “No.” Stack enough of those answers together and it starts to sound like Dr. Tufts did absolutely nothing. But there’s a question I kept waiting for someone to answer: Was she actually supposed to do all of those things? Lindsay Clancy was an adult responsible for her own medical care. She had not been legally determined incapable of making her own decisions. According to Tufts’ testimony, Lindsay repeatedly denied suicidal and homicidal thoughts, and Tufts testified that she never observed Lindsay to be psychotic during her treatment. So what was the actual standard of care? If an outpatient psychiatrist treating a competent adult was expected to call her husband, her parents, the hospital and independently investigate everything occurring between appointments, establish that standard for the jury. Because “You didn’t do this, correct?” is not the same thing as establishing that she SHOULD have done it. And there is an even bigger issue I keep coming back to: When are we going to hear someone actually explain psychosis to this jury? Psychosis has become central to Lindsay’s defense. Yet we’ve spent days hearing about medications, anxiety, depression, intrusive thoughts, sleep, suicidal ideation and Lindsay’s mental-health treatment. I want to hear qualified experts explain exactly what psychosis IS. What are the clinical signs? How is it distinguished from severe depression, anxiety, intrusive thoughts or suicidal ideation? What evidence demonstrates that someone has crossed that line into psychosis? And then comes the question I believe may be one of the most important of this entire trial: What actual evidence shows that Lindsay Clancy was psychotic when she killed her children? Because mental illness alone does not answer that question. Being depressed doesn’t automatically mean psychosis. Being anxious doesn’t automatically mean psychosis. Having intrusive thoughts doesn’t automatically mean psychosis. Being suicidal doesn’t automatically mean psychosis. We know Lindsay was struggling. We know she sought treatment. We know she was prescribed numerous medications. But the defense is asking this jury to make a much bigger leap than simply accepting that Lindsay was mentally unwell. And I haven’t heard enough evidence yet to make that leap. Dr. Tufts testified that throughout more than a dozen appointments she never observed Lindsay to be psychotic. Other providers have testified about Lindsay’s mental-health struggles and treatment. Eventually, though, someone has to connect the dots. If the defense’s position is that Lindsay was experiencing psychosis when she killed Cora, Dawson and Callan, then I want to hear the medical evidence supporting that conclusion — and I want to hear the prosecution’s experts challenge it. THAT is the testimony I’m waiting for. As for today’s cross-examination, questioning Dr. Tufts’ judgment is absolutely fair game. But using everything we learned AFTER three children died to create a list of everything she supposedly should have known BEFORE it happened feels dangerously close to judging her treatment entirely through hindsight. Establish the standard. Explain the medicine. Then let the jury decide whether the evidence actually supports the defense’s theory. Because right now, I still have a lot of questions. #LindsayClancy #LindsayClancyTrial #JenniferTufts #TrueCrime #Courtroom
