A dui is not a simple traffic violation, it is a crime that can involve up to a year in jail. So it’s a criminal investigation. He should be entitled to a lawyer.

How is that even remotely logical, at the point that he wanted to call his lawyer she decided to arrest him making it his right to call his lawyer. This system really needs to be burnt to the ground and built correctly.

Any time compliance is optional the cops should be required to tell you, like a Miranda warning. If you aren't required to submit to a field sobriety test, they should have to tell you and failure to tell you should be grounds for all the subsequent evidence to be excluded.

things that will probably cause a bunch of a stir: 1) video shows him asking if he is allowed to call his lawyer, and the response being "you're under arrest" 2) after he asked for a lawyer, they brought him elsewhere and continued to a) question him and b) perform "field" sobriety tests not in the field none of this stuff is directly related to the exact question being asked, but its stirred up alot of speculation

I think you got this one wrong. As you said he wasn’t yet under arrest. So he did have the right and freedom to call a lawyer. Just like you have that right any time of any day that you are under arrest.

He has every right to call his lawyer but if he’s not doing FSTs then he’s gonna be arrested right there. He doesn’t get to prolong the arrest to make a call. He can call from jail.

when I got arrested in Tennessee they refused my rights to call an attorney and no Miranda rights was told to me no attorney down there would take my case

I have watched approximately 479283 DUI arrest bodycam videos. The field sobriety test is 100% subjective. They lie and state that since they have specific training, things like the eye nystagmus test is objective but it’s not because they will perform the test over and over and over and over until they see what they want to see. I would never ever agree to a field sobriety test, even if completely sober, because it is not a scientifically sound test. Test my breath or blood or whatever the judge orders but no FTS.

Just for anyone, wondering they legally can’t make you do any field sobriety, tests, or breathalyzer and personally I would require them to take me to the hospital for a blood draw. That’s the only way it’s gonna happen.
