My manager asked me to have FMLA paperwork completed because the overhead lights bother me (bright lights aren’t good for migraines). Well…my PCP completed the FMLA paperwork pertaining to my entire medical history and stated I need to completely work from home (lots of medical issues -work is not aware). My manager said we can not accommodate, we don’t do that. Very large international company.

Thank you for what you do. Question, what do you think about companies denying disability reasonable Accomodations as working remote, years remote good performance. But after EEOC charges now they put working “on-site” as an “essential function and denied Accomodation for remote. They don’t use “undue hardship” and company want an accommodation that keep employee onsite. Your thoughts?

During my RA interview, which wasn’t an interview but more a speech given by the rep, she said the following things: I could “accommodate myself out of a job” so I needed to be careful what I asked for. She said that because I got 2 days remote already and I only asked for 1 day additionally that they could revoke my other “benefit days” (I asked for 3 days at home). She said that people talk to her during these interviews and come back afterwards and have “mysteriously been cured” of their disability. Mind you, this was all said to me after she talked to my doctor and told me I was approved and she could confirm I had a disability.

What about employers that are refusing to promote anyone that works from home. Not ADA related. If you aren’t near an office you will never be promoted.

It’s almost impossible to find a lawyer in upstate ny that works on contingency. The interactive process unfortunately zeros out the essential job function thing (seemingly). They don’t have to give you what you ask for unfortunately.

What about them making the blanket change that we can no longer work 4-10’s and everyone must work 5-8’s? That’s the position I’m in right now. I have health issues, and so do 2 of my 3 kids, and that one weekday was designated for appointments

What about if they continue to let you work from home for an accommodation but wants you to live within 30 minutes of a hub so you can go in for staff mtgs? Would req move out of state. They will pay for move. Thanks! 😊

Do you have to have the disability on record with HR prior to the mandate? If they were adequately accommodated working from home that they didn’t need to disclose their disability, and suddenly have to go in, will that weaken the case? Or does the disability simply have to be a diagnosis only shared when accommodations are needed?

I work from home on an accommodation and when I wanted to apply for another position they said I had to go to training in office for 6 weeks. We do teams meetings several times a week I don’t know why I couldn’t attend training remotely but I was wondering if it is illegal for them to do this?

make a post to reddit in the California state worker sub. all 200,000 of us were ordered 4 days in office (from 2) July 1, and most agencies (like mine 20,000 employees) disallow ANY reasonable accommodations.
