Diego Sarabia’s attorneys have asked Judge Phaedra Perry-Bond to restrict what the parties and their lawyers can say publicly about the Cornell civil case. The filing, made October 9, runs nine pages and accuses Jane Doe’s attorney, Thomas Giuffra, of waging an “orchestrated campaign” in the media. The defense points to 23 public statements across CBS, CNN, NBC and The Cornell Daily Sun and argues the publicity could contaminate a future jury pool before discovery is even underway. Fine. That is a legitimate legal concern. Pretrial publicity can absolutely poison a case. Jurors should not walk into court with a verdict already downloaded into their brains. But let’s not perform a little legal sleight of hand here. “Protect the jury pool” is not the same argument as “Jane Doe’s lawyer needs to stop talking because his version of events is gaining traction.” The proposed order would apply to both sides and would restrict statements creating a substantial likelihood of material prejudice, discussion of nonpublic evidence, identifying information and communications encouraging harassment. Good. Then apply it evenly. Because this case did not become a media spectacle because one attorney discovered television. Defense lawyers have given interviews. Competing narratives have been pushed publicly. Confidential records have surfaced. Online vigilantes have doxxed completely unrelated people. And the internet has conducted enough unauthorized prosecutions, acquittals and forensic reconstructions to qualify for continuing legal education credit. Giuffra says the motion is an attempt to silence him because his public responses have been effective. He also accuses the defense side of leaking confidential information and attacking the lawsuit. Those are his allegations. A judge has not found them true. And here is the part social media desperately needs tattooed onto its collective forehead: The judge has not granted the gag order. A motion is not an order. A request is not a ruling. An allegation of prejudicial publicity is not proof that prejudice occurred. And restricting what attorneys say publicly will not make the existing documents, testimony, police records, Title IX materials or unanswered questions evaporate. So yes, protect the jury pool. Protect Jane Doe. Protect the defendants. Protect innocent people from doxing and harassment. But when a case becomes deeply uncomfortable and the proposed solution is suddenly less public discussion, forgive the public for looking very closely at who wants the volume turned down and why. Because sunlight did not create this mess. It just made it harder to hide. #cornell7 #janedoe #cornell #courtwatch #dueprocess
