His attorneys argue prosecutors have failed to establish the sole aggravating factor needed to potentially seek death, pointing to one key detail: only one shot was fired, it struck Kirk,  no one else was hit and the bullet's downward trajectory posed no risk to the crowd. "The only evidence presented supports that the bullet travelled above, not through, the crowd." Prosecutors get their chance to respond next week. Judge Tony Graf Jr. is expected to decide Sept. 1 whether the case has enough probable cause to move toward trial.
