The only reason they take you to court is if they believe they have a chance of getting paid as it cost them money. So it’s a gamble on their part as if you prove you don’t have any money then it’s a £1 a month for life and depending on your view or circumstance that might be the better option as once you are paying the £1 for life you can then sort out your life yes it effects your credit score but again if you’re in financial trouble borrowing money isn’t high up on the things to do😳😳😳

You need to get a LBA before they can take you to court and they’ll provide 30 days to reply. This is when you ask for proof of the debt.
