In Georgia they can just arrest them and then consent isn’t needed and hospital has to draw the blood

Dave :
Even if the got the blood it would have been useless. You can’t get bloodwork without a warrant or consent. The officers should have already known this.

I’m with the hospital team on this one. Cops on this one have to follow the laws of the land. She didn’t, if he dies there is now way she’s getting that blood because it would be useless.

Well hell, they have him on IV fluids. That will save him. Why didn't I think of that? I am so glad that officer is a medical expert that can remind us.

It’s sad that the family got hurt, but it would have been worse if the officers got the blood only to have a judge toss it and the charges out for lack of protocol. The officers, police chief, and the prosecutors should have already known this. The nurse and doctor are 100% correct in this matter.

Yes, a hospital or its medical staff can refuse to perform a forced or non-consensual blood draw requested by law enforcement if it violates medical ethics, hospital policy, or exceeds legal boundaries. While police often request blood samples for suspected driving under the influence (DUI/OWI) cases, medical personnel are not law enforcement agents and are bound by the duty to "do no harm".When Hospitals and Staff Can RefuseLack of a proper warrant: Without an explicit search warrant, court order, or true emergency exception, drawing blood against a competent patient's will constitutes battery or assault.Medical contraindications: A physician or nurse can legally and ethically refuse a blood draw if they use good-faith medical judgment and determine the procedure poses a physical risk or danger to the patient's health.Policy and liability: Many hospital risk-management policies instruct staff not to act as agents for police collection unless strict statutory and immunity guidelines are met, protecting the facility from civil liability.Patient and Provider RightsPatient autonomy: Competent patients have the legal right to refuse invasive procedures, including blood tests, though refusal can carry medical or legal consequences outside the hospital.Staff protection: Healthcare workers cannot be forced by police officers to perform a puncture without proper legal and medical clearance, as seen in landmark cases where arresting officers overstepped boundaries.
