In the drug development industry when a company develops something new to market and funds all the research to get it approved they are protected for a certain duration before anyone else can make and sell a generic. If not they couldn’t recover all the cost of development and trials. This is nothing new and has been in place for years. We seen it with the medicine that was developed to treat our daughter’s rare disease, that’s why it cost $125,000 per injection.

It is a drug at this point. What it isn’t yet is a medication. And the suits they filed have to do with unfair trade and competition practices - they stated that distributors are free loading off of them and the trials they’re paying for. The patent they have has nothing to do with naming… they have a patent on the chemical structure and peptide sequence that is retatrutide. They have rights over that molecule, not the name.

If they legitimately submitted Rita for FDA approval as a simple compound, they would already be selling it however because they’re greedy they wanted approved as a biologic, not only to have 12 years exclusivity in the market but also so they can charge more as well as potentially have more control in the market.
