The surrogate mother told on an interview that the couple convinced her that they will do everything for the baby , they want a baby and no one thinks about abortion…. When they told her be ready for abortion, the surrogate mother thought they didn’t do enough for a baby as they promised. The baby already was a baby with all organs and senses and She didn’t want to kill him, it was a good chance for him to survive, of course with surgeries but those surgeries are available. The difference between the biological mother and the surrogate mother that a biological mother didn’t go through pregnancy and didn’t feel the baby, every movement, every signs of him in her, she didn’t care that much for the baby. I'm not a lawyer...but I'm thinking...if the intended parents claim damages based on the child's medical condition, they need an independent legal theory connecting that loss to an enforceable obligation of the surrogate. Surrogacy is not a UCC governed contract so If the law insists that the child isn't the object being purchased, what exactly is the contractual object? A surrogacy contract is necessarily subordinate to legal regimes that govern the human body, medical decision-making, parentage, and the welfare of an actual child.They will need to build legal bridges to justify damages. Contract → enforceable duty → breach → causation → legally recoverable injury → amount of damages. If one of those links fails, the particular damages claim can fail without anyone having to pretend the entire concept of surrogacy is legally invalid however to facetiously attempt to utilize aspects of tort law to litigate against the surrogate is strange.

If the underlying action (forcing an abortion) is legally impossible to compel, how can the refusal to perform that action generate financial liability?In contract law, if a contract requires a party to do something that violates public policy or constitutional rights, that specific clause can be void ab initio (void from the beginning). Surrogacy contracts only succeed when there is no medical complexity. These contracts settle the legal parentage of a child very well however, a contract cannot legally mandate what a court has no legal authority to enforce without the violation of superceding laws

Unfortunately, this is a contract and a business agreement. I think they had that agreement about Birth defectsand abortion. This woman probably is not cut out for surrogacy. I think that’s a very hard thing to do. That’s genetically not her kid though.
