What if he only needs to show the jury that the Commonwealth hasn’t proven its version of what happened beyond a reasonable doubt? That’s the part of his strategy I cannot stop thinking about. Especially considering how many questions he has already raised using the prosecution’s OWN witnesses, before the defense has even presented its case. 👀 And maybe the bigger question is this: Did investigators fully investigate what happened? This!!! I keep explaining this basic legal tenet — the burden is on the COMMONWEALTH to prove it BEYOND a shadow of doubt that Lindsey did it. He doesn’t have to prove anything— he has to point out that the prosecution can’t. And even the judge reminded the jury of this responsibility.

This is literally how criminal defense works. The state has the burden of proving that the defendant committed each and every element of the crime beyond a reasonable doubt. The defendant doesn’t have to prove anything at all.
