@luvisialegal: Kenyan land law recognises the doctrine of adverse possession. In simple terms, a person who occupies another person’s land openly, continuously, exclusively and without the owner’s permission for at least 12 years may, in appropriate circumstances, apply to be recognised as the legal owner. But this raises a difficult question: Is it fair for someone to lose land simply because they failed to assert their ownership rights for many years? The justification is often that the law must balance private property rights against the wider social interest in ensuring land is not left unused indefinitely while another person has possessed and utilised it for a long period. 📌 Should adverse possession continue to exist in modern Kenyan land law? #LuvisiaLegal #LegalEducation #kenyantiktok #kenyantiktok🇰🇪

It is law, and for as long as that law remains in place, it is possible. We call it adverse possession. I did a video explaining it. There is a valid moral argument against it though 🤝.

Fake law. if land is fully owned by individual after spending alot of money , it should not just go like that whether idle or not. Let government buy it if they don't want idle land.

If they are not using the land, then that means they don't need it, it's more unfair to have idle land when others are suffering.

It is legally valid, but ethically disputed: it protects long-term occupiers and encourages land use, yet can punish idle owners, reward opportunism, and create insecurity around property rights and ownership🤔
This is legal dilemma based on moral values 🧐

What she failed to say is stay there "UNINTERRUPTED"... The law is meant to prevent land from going to waste if the owner doesn't care about it (hasn't visited in 12 years).
