unemployed HR girlie here: you can report the misclassification to the department of labor or your state's labor commission office. best evidence is if you can show full time employees performing the same duties with the same access.

Happens to nannies all the time! Like how often are you working completely independently and on your own schedule with someone else's kids?!

KNOW YOUR WORKER'S RIGHTS! do NOT let companies misclassify you. if they do, you can report it to the IRS with form SS-8. a company does not decide who counts as an employee or not -- the IRS has rules employers must abide by so do NOT hesitate to report!

yep, if you’re 1099 you must set your own hours, wear what you want, provide your own tools. all the “company” can do is provide you the task, the deadline to complete it, and the quality expectations

Yup… this has been happening for yearrrsssss! They just end contracts. But the expectation is that you function like a full time employee. This is very prevalent in biotech jobs. They would essentially have people take a month off so their “time” could restart.

It’s very illegal, but the people who are supposed to enforce these laws don’t care, so we’re screwed.

This is the shifting of all work towards the gig economy. Which is to say everyone is employed for limited amounts of time, made to be contracted workers, and the job goes to the person bidding for it (read desperate enough) for the lowest negotiated pay. No benefits, less pay, less hours, and no job security.

it's called a loophole and it's brilliant for employers to get people to accept positions and not give them benefits

its called missclisification If your employer has misclassified you as an independent contractor, you should contact the U.S. Department of Labor (DOL) Wage and Hour Division, the Internal Revenue Service (IRS), and your state's labor or unemployment agency.

Higher ed has been doing this for decades. The college/universitywork force is now predominantly adjuncts with PhDs (and attendant debt) on 4.5-9 month contracts with no worker protections. THAT’S been the goal of eliminating tenure, BTW.

I had my contract continually extended for 2 years when I worked at paramount & then they just cancelled it during the layoffs in 2024. All of the streaming services just hire temporary contractors & just cancel it after a year or so

If u are a 1099 contractor and u are treated as an employee AT ANY POINT—-automatically a lawsuit….prime example…if u are told that u can or cannot do something that isn’t in ur contract then that would be considered telling u how to run ur business
