@blackbeltbarrister: What is self-defence in English and Welsh law? When are you legally allowed to use force to protect yourself or someone else, and how much force is considered reasonable? I explain the law of self-defence, including reasonable force, imminent threats, pre-emptive strikes, defending another person, and when self-defence can fail. #BlackBeltBarrister #Law #UKLaw #SelfDefence #SelfDefense #EnglishLaw #WelshLaw #CriminalLaw #ReasonableForce #KnowYourRights #LegalRights #Crime

Correct me if I’m wrong, but I believe you also have to explain why you had the bat. Keeping an object for the explicit use of being a weapon isn’t legal, even if it’s by your bedside in case of a home intrusion.

what if the person using the force is disabled or otherwise vulnerable? They know if that person, say a home invader, will easily over power them, so they literally have one chance, so they use disproportionate force but subjectively and genuinely believed if they didn't stop that attack Immediately that reasonable objective force would not be available to them?

Yes. But where does the objective bit sit. Has the person, the jurer, been in a similar situation.

“In my honest belief I feared for my life or the lives of others if I didn’t immediately act”. It’s a key part to the rules of engagement training we get in the military. Having to do the judgement assessment on werher it was a legal shoot or not was always nervous!!

Is the Clapham Omnibus used? I understand it was a litigation case but has it moved into criminal law, especially around the use of force?

I and my dad defended ourselves against attackers years ago. The police photos showing their injuries was horrible, they had a good kicking but the attackers had taken drugs and couldnt feel the pain at the time. Looking back i find it interesting how their use of drugs changed the whole situation and the amount of force we had to use to protect ourselves

So “I thought it’d be a laugh” is NOT a defence?
