She was called by the defense today to explain what Lindsay Clancy’s injuries may tell us about HOW she went out that second-story window. And the Commonwealth did not ease into this cross-examination. Almost immediately, the prosecutor went after Dr. Laposata’s professional history. She brought up the fact that the Rhode Island medical examiner’s office had once been cited for 10 violations and unsafe conditions while Laposata was chief. Then: “You didn’t treat Ms. Clancy, correct?” “You didn’t examine her yourself, correct?” And then she started challenging Dr. Laposata’s interpretation of Lindsay’s Jefferson fracture — asking whether that type of injury could also occur from striking the back of the head or shoulders instead of the top of the head. In other words: Before attacking the conclusion… attack the credibility of the person giving it. And technically, that is part of cross-examination. The Commonwealth is allowed to challenge an expert’s background, methodology, assumptions and conclusions. But WATCH Dr. Laposata during this exchange. Because by the end of this opening line of questioning, she looks like she has heard quite enough. 😳 And then comes that final… “No.” No speech. No argument. Just… no. 😂 Now here’s the actual issue underneath all of this: Dr. Laposata testified that Lindsay’s injuries — including the Jefferson fracture, multiple spinal compression injuries, a broken rib and damage to her thyroid — were consistent with Lindsay going out that window head first. The Commonwealth is trying to establish that those injuries do not necessarily prove the exact mechanism the defense is suggesting. That is a completely legitimate question for the jury to evaluate. But WOW. The tone of this cross-examination changed immediately. And we were barely getting started.
