It is an oxymoron question. The judge should exercise the spirit of the law, that is to prevent crime. The case should be thrown out of court and the robber should be charged for the cost of tge attoney and court tine. This will deter future robbery and wasting court time.

Robbers are putting themselves at risk on their own because it's not everyone who would peacefully give them their belongings. Other victims fight back in self defense to retain their belongings. In the end the Robber started the ordeal and must be answerable to all that has happened. Who wants to stay in such a community where perpetrators are allowed to sue their victims.
