If they dont actually leave, the case can be dismissed. Even the fact that they are not physically seeing her do it can be an issue. We had to see them take it with our eyes, know exactly what they took and maintain visual contact until they pass the last point of sale. Once outside, we had to state to them what that item is before they show us. Yes, in CA Undercover LP can legally put you in hand cuffs and bring you back into store. LP can use force. LP can and will chase you. They are not employees at the store, they work for a private contractor and are essentially doing a citizens arrest, LP guys write the report, the police verify and transport the suspect. The police literally put their own cuffs on the suspect and give the LP back theirs. LP rotate everyday, Never work the same store twice in a 3 month period. We had mirrors hidden in shopping carts. So if you see someone pushing a FULL cart with no perishables in it, might be LP!

I know here in Michigan , they will let you steal over and over again. Then when all the incidents reach over a 1000 dollars they charge you with felony theft. Because all the merchandise together over weeks of theft added to 1k or more.

I had a mis scan once lady came over and verified everything. went to doors. and got stopped saying I stole the item that didnt scan correctly and another worker verified. power hungry little shits in those offices. lol

The more you build the case with video the more you have for a better prosecutable case . That way they get comfortable stealing and they do it more. That’s why retail theft is out of control. They need to lower the threshold on felonies in each state so these people actually do actual time instead of getting kicked loose on a ticket never getting caught until they steal again. I spent 30 years as a assets protection, investigation’s manager. It has changed over the years. Safety comes first now. Unfortunate that they don’t make the laws stricter as small businesses are the ones that are paying the price more and closing Good job on your cases.!
