When someone passes away the assets in their estate generally get a stepped up basis. The value resets to what those assets are worth on the date of death, not what was originally paid for them. For my high net worth clients the first thing we do is get appraisals and valuations on everything. Every piece of real estate. Every investment account. Every business interest. We document the date of death value carefully because that becomes the new basis going forward. For jointly held and community property assets this can eliminate significant capital gains when the surviving spouse eventually sells. We also file a 706 to elect portability, so no exemption goes to waste. Everyday families miss this window entirely. Nobody tells them it exists, and once it closes it does not come back. Can you not use the county auditor value if they don’t get an appraisal in time? Not ideal when real estate is doing well, because the auditor appraisal value will be lower, but better than nothing. Genuinely curious, because I’m an estate planning attorney too (Ohio) but only a few years in lol. I haven’t had this come up yet but my first thought was at least we’d have the auditor value to fall back on & reduce the capital gains if they don’t come see us soon enough to advise otherwise.

Hi 👋- how exactly is this valuation documented to effectively “reset” the basis? Because it’s usually set by the acquisition (purchase at $100K in your example). So are they transferring or selling the real estate to themselves in order to reflect a new value on the deed??
