I think for me it’s not that she decided to not have an abortion, it’s the fact that she signed a contract with an abortion clause in it while being pro-life. If your values don’t align with a contract, don’t sign it. Period

I don't see enough people talking about how the parents set up medical care for Rumi in California when they realized the abortion wasn't going to happen. Yes they wanted the abortion but they also weren't trying to force her into it when she changed her mind.

Regardless, she had bodily autonomy in CHOOSING to sign a contract that has that type of clause in there. She could’ve gone with a different couple or requested that clause be removed and chose not to.

Surrogacy is a job. It’s employment. No job removes your autonomy over your own body. If she wants to have the baby, she should have to deal with the consequences of a broken contract (ie pay any money back and assume responsibility of the medical costs for her kid for instance) but it is a wildly dangerous precedent to set that any woman should be required to either have a kid or abort one. If the surrogates life was at risk, they shouldn’t be forced to have the kid anyway and that’s the precedent something like this opinion is setting.

People are really unclear on exactly how surrogacy works. Yes, you are signing over your autonomy. Much like when you join the military you don’t have autonomy over your body any longer. You are owned by the government. When you enter into a contract, that’s the terms of the contract.

I'm glad to hear your perspective because I genuinely have been feeling very icky about contractually binding someone's body autonomy and feeling like surrogacy just shouldn't be a thing. But you're totally right about agreeing to give up your autonomy is just that. The contract supercedes her desire.

Thank you for bringing up my community… The adoptees. But I see that your entire comment section ignored that part. Surrogacy/IVF/adoption aren’t regulated enough and the ones who suffer is the child. Each and every time. It does not matter how the child was conceived trauma is always the end result. There should be a lot more regulation, including at least one year of child trauma informed therapy.

I don't agree, but primarily because I don't think there is any ethical way to lease someone's bodily autonomy. I'm strictly pro-choice for the pregnant person because of how dangerous pregnancy is (+ how inequitable these power dynamics often are). Hot take, maybe, but I would support her having an abortion against the wishes of the bio parents. And I would support her birthing this child regardless of the parents' wishes. And the associated risks (and penalties) should be factored in by those seeking to "lease a womb", and by the surrogate. Most surrogates would likely fulfill their end of the agreement, but just like with adoptions, nothing is settled until everything is settled. That being said, signing a contract agreeing to have an abortion if the prospective parents so desire, and then fleeing to a State where abortions are banned to escape is a shitty thing to do. But it's also a predictable risk in this political climate.

I'm concerned about how the publicnis unfortunately falling into the trap of this, because we have some people arguing that there are essentially exceptions to "my body my choice" which is a moderate/moderate right talking point. There are also people unintentionally making the case for regulation on womens health (& I even saw a very popular creator create a solution that was essentially a defense for conservatorships while under surrogacy contracts.) This is 100% why I think everyone should listen to adoptees, they have been screaming for people to understand that the market of "family-making/ children" is unethical.

respectfully, I disagree. I think that for any reason, regardless, you can choose what to do with your own body. I don't care if you've signed a contract saying that you would never have an abortion. and then decide to have an abortion. at the end of the day, that is your choice because it is your body. now I do think that because she broke the contract that she should be sued for breach of contract. but I do not believe that we should ever say that because you sign a contract saying something about your body that you can't change your mind. bodily autonomy does not go out the window cuz you signed a contract is what I'm saying.

If we have a problem with women choosing to rent out their wombs, then the law has to change. For those saying "you can't lease out your bodily autonomy," Yes, you can. That's what paid surrogacy is, and it's legal. I expect that a judge will rule that while the IPs couldn't force her to abort, she breached the contract, the IPs get custody of the child and the surrogate will have significant financial liability based on the terms of the contract. If this is a problem, the law needs to be changed.
