Here's what actually matters 👇 ➡️ The guidance takes effect September 18, 2026 — the same day the 2022 public charge rule is rescinded. ➡️ It applies to Form I-485 applications postmarked or e-filed on or after Sept. 18.File before that date and your case is still judged under the 2022 rule. ➡️ For benefits received BEFORE Sept. 18, officers only look at public cash assistance for income maintenance and long-term institutionalization at government expense. ➡️ For benefits received ON or AFTER Sept. 18, officers can consider any and all means-tested benefits — cash assistance, housing assistance, food stamps, college financial aid, and similar programs. ➡️ No single benefit = automatic denial. It's a totality-of-the-circumstances call across the five statutory factors: age, health, family status, assets/resources/financial status, and education/skills. ➡️ Many people are exempt entirely — refugees, asylees, VAWA self-petitioners, and U and T visa applicants are generally not subject to public charge at all. ➡️ USCIS is also releasing a revised I-485. Old editions won't be accepted on or after Sept. 18.
