Ordinary not guilty — The Commonwealth fails to prove the required elements of the charged offense beyond a reasonable doubt. Given the defense's position that Clancy caused the children's deaths, this isn't the primary battlefield in this case. � Massachusetts law makes the prosecution's burden unusually important here. Once sufficient evidence of lack of criminal responsibility is introduced, the Commonwealth must prove beyond a reasonable doubt both that she committed the charged crimes and that she was criminally responsible at the time. Clancy does not have to prove that she was insane
