FDA can issue exceptions for trial tests, for life threatening diseases or highly unusual circumstances. the mistake here is the doctor was too lazy to get authorization the argument is solid, desperate people will take more risks and doctors have to take care not to lead them astray, that's part of the hippocratic oath.
