Generally, a deputy cannot detain you solely for making people uncomfortable or for filming in a space where you are lawfully present, provided you are not trespassing or interfering with a specific crime or investigation. However, a restaurant is private property, and management or owners have the legal right to ask you to stop filming or leave. If you refuse to leave private property after being asked by the owner or manager, you can be trespassed, which does give law enforcement legal grounds to detain or arrest you
