@caitlinengstrand: What happens when the problem isn’t just one bad government employee… but the system itself?” That’s where a Monell claim can come into play in a federal civil rights case. Under §1983, a local government generally isn’t automatically liable just because one of its employees violated someone’s constitutional rights. Instead, we look deeper: Was there an unconstitutional policy or longstanding practice? Were similar violations happening repeatedly? Did policymakers know about the problem and fail to address it? Was there a failure to train that amounted to deliberate indifference? Sometimes a civil rights case isn’t just about what one person did. It’s about asking why the system allowed it to happen. #CivilRightsAttorney #Monell #Section1983 #CivilRights #LawTok @National Injury Attorneys

It's crazy that this country has had 250 years to work out the training bugs and yet here we are. I get the sense that it isn't that proper training is unavailable, but that they are training them improperly on purpose. I see it across multiple areas of law involved employment. Almost like the employees are being made to be the fall guys for the intended outcomes their improper training creates.

punative damages come out of the officers actual pocket. Also if you sue the whole police dept and not an officer in a private compacity you have to prove their policy was bad and mistrained their employees. My question, does this bypass the qualified immunity standard when you're going after the entity not the individual person?

We are in NC and we’ve had department of child family services wrongly remove our children. We’ve had them take our kids without any compelling evidence and/or imminent articulated risks or witnesses just hearsay they have filed false information to the court they aren’t following the court order and they aren’t following their policies and procedures! We’ve spent over 20k and counting on attorney fees since December 1st???!!??

I don't need an explanation I need someone who can legally fight that battle for me this is intentional part of the reason they kept me poor? so that I can't afford a lawyer to protect myself from them I don't need people telling me I'm doing it wrong I need people who can do it for me. everyone keeps expecting me to magically have a law degree and do this myself instead of stepping up with their law degree and experience and fighting the battle
