A jury in Georgia today (Friday, December 5) acquitted a 21-year-old woman of maliciously murdering her boyfriend's toddler son but convicted her of five other felonies, including two counts of felony murder. The mixed verdict against Trinity Madison Poague highlights how different states prosecute homicide differently, with some states charging malicious, pre-planned murder as first-degree murder, with lesser-serious charges of second-degree murder and manslaughter. In Georgia, malice murder is the most serious homicide prosecution, but felony murder still can bring a sentence of life in prison. Poague, a former beauty pageant queen, cried in apparent relief when Judge W. James Sizemore read the not guilty verdict for malice murder, but her demeanor changed as he said she'd been found guilty of the other counts. In addition to two counts of felony murder, Poague was convicted of two counts of aggravated battery and one count of cruelty to children in the first degree. Prosecutors argued that Poague, who was Miss Donalsonville in 2023, killed 18-month-old Romeo Angeles (also known as Jaxton Drew or J.D.) because she wanted to have her own child with her boyfriend and resented the attention the boy received. Trial evidence included Internet searches Poague made while the boy was hospitalized including, "How do you get a brain bleed?" and "How can a depressed skull fracture go unnoticed?" She first told investigators the child fell off a bed while eating chips. The trial was in Sumter County Superior Court in Americus, about 140 miles south of Atlanta. #law #court #crime #legal #judge
