Hank knows enough about the law that he is able to manipulate the situation after the fact knowing that his higher ups will back him. We see this multiple times in the show. As to people saying why didn't he call for backup etc. Hank is somewhat going rogue at this point, he was already told to drop the case but he can't help himself because he feels that he's onto something and needs to prove it.

This scene bugs me. DEA agent alone and doesn’t call for backup or for uniformed officers to stand by. Then the crazy amount of time it took Walt and Jesse to leave after Hank went to the hospital is not believable. They were in no rush. Dumb
