NO ARREST On February 9, an FHP trooper running radar on US 192 clocked a motorcycle at 111 mph. His first reaction, caught on his own patrol car camera, was "He's going to jail." Then he found out who was on the bike. "Yeah. Fultz. Sheriff's Office." "Dude! Bro! I didn't recognize you!" Trooper Joshua Provencher went back to his cruiser and called a sergeant. He said the rider was passing two other bikes in a fairly decent amount of traffic. Then he said the quiet part out loud: "If I can avoid the 10-15, I don't want to ruin his job." 10-15 is the radio code for an arrest. He came back and told Deputy Michael Fultz: "I'm not going to take you to jail, Fultz. Obviously you and I are buddies. I'm not trying to show favoritism, either." Look at the citation. Box checked: 74 in a 65. Nine over. Civil infraction, $155, no court appearance. Now read the narrative box the trooper filled out on that same piece of paper: "VEH WAS CLOCKED AT 111 IN A POSTED 45MPH." Florida's Super Speeder law took effect July 1, 2025. It is a criminal misdemeanor to drive 50 mph or more over the limit, or 100 mph or more in a manner that threatens others. Up to 30 days in jail, a $500 fine, and a mandatory court appearance. There is no paying it online. BCSO investigators later wrote that Provencher was aware Fultz's speed and the traffic conditions "met the statutory criminal requirements" of the Super Speeder law. Fultz himself admitted to investigators that his speed violated it. He also did not have a motorcycle endorsement on his license. Troopers are authorized to impound a bike over that, and a conviction carries up to 60 days. He wasn't cited for it. The bike wasn't towed. He never reported the stop to BCSO, as agency policy required. Five weeks later, on March 13, Sheriff Ivey handed him the 2025 Deputy of the Year award. Fultz resigned in May as Ivey was preparing to fire him for what the agency called "egregious misconduct." We sent FHP requests for comments on the circumstances surrounding the ticket. Now consider the pattern. This is the same agency that took roughly a month to cite former Titusville Police Chief John Lau with careless driving and an open container after he rolled an unmarked police vehicle off duty and refused a drug and alcohol test. No DUI charge. No arrest. Ask yourself what happens to you on US 192 at 111 mph with no motorcycle endorsement. You are going to jail. Your bike is going on a hook. You are standing in front of a judge in Viera with a criminal record following you into every background check for the rest of your life. The badge is supposed to be a higher standard, not a discount code.
