Oregon has the Guilty Except for Insanity plea, and there are sentences that are structured that way, but it's not 100%. I am a forensic psych nurse and I've had clients leave to prison while serving their sentence, but I've also seen clients who are able to go to the community or who stay at a facility indefinitely. So much depends on the crime, the county, the judge, etc. These cases are so nuanced and most people have no idea. (I'm not disputing anything you said in this video, just adding what I know about my state. Thank you for talking reasonably about such a misunderstood issue. )

taking ur children's lives when you don't have control of your mental health then knowing it when you snap back has to be its own mental illness on top of it especially when you begged for help and tried to do the right thing. I wouldn't want to leave either.

As a worker in a state run facility for those who have been deemed by the court as criminally insane they are there for rehab. Go get them stabilized. People assume they’re living their best life. But that’s not the case. At all. Most would rather be in jail tbh

Thank you for speaking on this!! The fact that so many people are confused/ignorant on PPD/PPA/PPP. Insanity doesn’t absolve you of guilt, it changes the type of punishment the defendant receives (prison vs mental health facility). It’s not easy to get out. Andrea even waives her review. You have a legal background, right?

Its so bad here in Idaho. It would take me hours to explain how bad it is here for the mentally ill. Especially as someone who has had all 3 of their siblings diagnosed with schizophrenia and is a nurse.

My mom has major depression, while I have minor. I played her I'mNotALawyer's coverage of The Clancy trial, and it was very interesting to hear perspective as a Black woman in the South. My sister's in med school, and she mentioned that they had discussed some of the testimonies from Lindsay's health care team.

I still remember seeing Andreas interview with the cop. she was telling them she had to save her kids by ending their lives. she seemed so sure this was the right thing to do. you could tell she was gone.

But we should all be having more kids, especially if we cannot afford them🙄 This is the bad place. There's little to no post partum support. Not to mention if you don't start support immediately, you can't get it later. They'll also cut you off at 1 year as if everything magically stops on babys first birthday. I swear, if Kamal were president we'd have sweeping reforms, for actual support, happening right now!!

at about 21 I already had my 1st unalienable attempt and my first manic episode where I did many things that I would not have done by rational choice. I was in medications that helped and were dangerous for pregnancy and then the Yates case happened and I knew I would never have children. I knew even adoption was out of the question because what if my medication failed? this might sound extreme for some and I don't judge people who take other paths but at 50, even though I don't have a violent bone in my body I know I'm my heart i made the best choice

I know a guy in Texas who Xed his whole family while high in the 60s (he was 15), was found not guilty by reason of insanity, went to a mental hospital for six years, was released, changed his name and moved to another state to be a teacher. I think that kind of thing from back in the day is where the concept of "insane but released" stems from.

Whenever I think about Andrea Yates my heart breaks a little bit more. I've watched a few videos over the years detailing what she was going through leading up to the crime and realizing just how badly *everyone* around her failed her - and worse, in my opinion, pushed her towards this - makes me wish more was done to hold the people around her liable. A doctor told their family she couldn't have more children, and the husband just chose to ignore it. The way she showed very obvious signs things were horrifically wrong, yet her husband and extended family just pushed her to have more children and treated her like she wasn't trying hard enough when she physically, mentally, could not care for herself or her children... That's a horror story I'd never wish on anyone.
