@attorneystara: Why did the #lindsayclancy prosecutors ask the religious questions about Father Bob, Sue Clancy and the Mortal Sin and the queries of the Chaplain? I think the answers live in the Jury instructions on the #insanitydefense #ngri To be clear I still find it yucky but I do think I have found their logic. #lawyersoftiktok

This is where it shows they lack basic psychiatric knowledge. Psychosis often comes with “sending people to god”

When you encounter patients who are hearing voices, the number one entity people say they hear is god. (Source: my mom was a social worker)

It’s still a dumb strategy. How many times in the Bible does God kill or order others to kill, especially children? So they really wanna get in. a tit for tat over Bible verses with the defense?

seeing this after today’s near mistrial 😭 I get that they were trying to make a point, but that’s exactly why it’s problematic!!!! The jury isn’t deciding whether Lindsay had been taught throughout her life that m*rder was a sin or morally wrong. They’re deciding whether, because of her mental illness, she could meaningfully appreciate the legal or moral wrongfulness of what she was doing at the time. Saying “she was Catholic, so she knew it was a mortal sin” or “morally wrong” skips over the actual issue the entire case is built around!!!! And without any real foundation about her personal religious beliefs, how strongly she practiced, or how those beliefs were affected by her mental state, it’s a really weak and prejudicial way to try to prove moral understanding 👎

But if she was , in fact, psychotic and not in her right mind, would she still have the ability to know that is also religiously “wrong”? (Genuinely asking )

How could they defeat the argument that she thought the voice telling her to do this was actually God? What about the argument that she was telling the children to “go with God” if she believed the voice was God telling her the only way they would be safe was to perform the commands of the voice? That could potentially be an argument.

In prosecution opening they called Lindsay a manipulative pill seeker, and now with their own rebuttal witness they're calling her medication resistant. (just in the past couple of days were trying to show she was taking too many meds) how did they not start this trial knowing what story they were going to go with? not being a lawyer, I know you've done both p & d.. wouldn't either side need to start with a clear narrative. Feels like most of the testimony they've gotten on direct or cross contradicts itself.

I wonder if the Prosecution realizes that Catholic teaching says God would never command murder, but a person who is psychotic may be unable to recognize that the perceived command is false. And that kind of loss of reality and free judgment is exactly what can easily support diminished responsibility. 👀

You’re right. The wack pediatric psychiatrist who testified for the defense today said that he believes LC using the phrase “Go to God” meant she was acknowledging they were innocent and thereby she was doing something wrong? That seems like a huge stretch to me, but I also didn’t find him to be credible 🤷‍♀️

Is it possible that postpartum psychosis and religious psychosis aren’t mutually exclusive?

I think your theory is very probably correct. mostly because arguing that "even if she didn't understand that it was criminal behaviour, due to her psychosis, she'd obviously still understand what a mortal sin is" is clearly moot and so ridiculous that it seems like exactly the kind of thing they'd cook up. 🤦‍♀️

I also think they struggle with pivoting or reframing their approach. When they ask a question, such as harping on the use of "quotation marks," the word "patient," or how she fell out of the window, and do not get the answer they want, they act like a dog with a bone. Rather than reframing the question or approaching it from a different angle, they just get more aggressive, asking the same thing louder and louder. And imo, it‘s off-putting.

I agree with you. However if she did it while in psychosis, I don’t think that argument works. They don’t understand reality at that time.

“Go to God” was actually used by their expert today as evidence that she knew right from wrong. I think you are absolutely correct, and I can see this all coming together now from what you realized. It felt like their expert knew exactly where the prosecution is going with this. I’m a nurse, and religious themes are well documented in psychosis, including postpartum psychosis. A person can understand that they are causing death while psychotically believing that death is needed, protective, or even morally right. He knows that as well or should, so this interpretation is sooo misleading.

I think you may be right, but that can be rebutted by god asking Abraham to do that to his son and his son was spared, so in a psychotic state she could believe god was talking to her 💁🏽‍♀️

It makes sense and kind of lines up with my theory that they were relying on moral outrage to get the conviction.

I mean God asked Abraham to sacrifice one of his sons. She could have thought it was "God" speaking to her.

I’m inclined to agree with you. The only thing that I think (should have) made them stop pressing the issue was when they asked about father bob and KR said something like “she sees this man for comfort, not for religious purposes because she’s not religious.” It’s still weird AF to me that they asked PCs mom that though because who gives a shit if his mom knows and recognizes that? If LC doesn’t then that’s moot in my opinion.
