Your lot may have been intentionally designed as a stormwater conveyance lot. Instead of the roadside swale simply continuing under another driveway culvert, the subdivision drainage may turn at the end of the cul-de-sac and use a side-yard/rear-yard swale or ditch to carry water to a downstream pond, inlet, wetland, or other discharge point. Pull your property survey and subdivision plat. Look for wording such as Drainage Easement, D.E., Stormwater Easement, Drainage/Utility Easement, particularly along that side property line and across the backyard. Then, ask who is responsible for maintaining that drainage feature, because that could fall to the homeowner, HOA/CDD, developer, municipality, or another party depending on the subdivision documents. Also, sometimes the developer anticipates that an end-of-cul-de-sac conveyance will eventually be piped or provided with a drainage structure, but the horizontal/site contractor doesn’t complete it correctly. You need to find out.

thats crazy! Maybe consider planting a rain garden? There are a ton of great trees, shrubs, and perennials that love wet feet, will help with erosion, give you some privacy and look great while doing it. bonus points for any natives

It’s a retention pond. The water needs a place to go. I wouldn’t personally buy a home next to a retention pond. Build a fence so your kids can’t get into it.

that isn't the builders rules folks. Please understand this before complaining....it is the city rules for runoff. it has to be controlled and not allowed to all just runoff into the woods or even an already made ditch or creek. It is the STORMWATER MANAGEMENT of your city.
