@emilygiffinauthor: There is a lot of confusion about this case and a widespread misunderstanding that Lindsay’s plea was “not guilty by reason of insanity” which in Massachusetts is actually called “not guilty by reason of lack of responsibility”. Same thing. But let’s be clear: this was not her plea. Her plea was simply NOT GUILTY. So the jury has three choices: 1) Guilty —> prison 2) Not guilty —> go home 3) NCR (guilty but insane aka Not Criminally Responsible) —> stay committed in the hospital Also keep in mind, what Reddington thinks happened that night might not be reflected by his legal strategy. See video. And finally, there is nothing in the evidence that the jury is considering that includes a confession by Lindsay. An opening statement is not evidence. Her alleged statements to doctors and Patrick can be introduced into evidence but do not change her “not guilty” plea into an admission of the crimes charged. In Opening Reddington explicitly used the words ‘she wasn’t trying to wipe out her family so she could start a brand new improved life’ they didn’t mean anything at the time but now seem oh so deliberate. I can’t imagine he will overtly push a third party defense but his closing statement is going to make history. And make Patrick shudder and quake.

Her arrest and this case was built upon Patrick saying that she did it. The prosecution failed to prove that beyond a reasonable doubt. Everyone following the case can see a chain of events that failed the children and Lindsay. Whether she did the act while drugged and in psychosis or whether someone else did this, Lindsay died twice (coded) due to her injuries and those precious babies lost their lives. The investigation, the lies, the crime scene not being secured, phone records sealed, cameras unplugged or removed, WiFi “not working”, the lack of dna evidence, the children being cremated, Patrick’s behavior which is beyond bizarre & suspicious all add up to confusion. But they arrested Lindsay because Patrick said she confessed that night.

Regarding the stipulation: There was a stipulation, but it was much narrower than an admission that Lindsay Clancy committed the murders.
On August 4, Lindsay personally agreed in court to stipulate to certain forensic/evidentiary facts. The judge questioned her outside the jury’s presence to make sure she understood that, by stipulating, she was agreeing that the Commonwealth did not have to call witnesses to prove those particular facts and that she was giving up her right to confront those witnesses.
The stipulations primarily concerned chain of custody and forensic testing—including DNA/blood/bodily-fluid evidence, exercise bands, and toxicology testing involving the three children.
Reddington explained why the defense did it: it eliminated the need for the prosecution to bring in dozens of witnesses simply to establish chain of custody and other uncontested forensic foundation.
But—the stipulation was NOT a guilty plea and was NOT a stipulation that Lindsay murdered the children. Her plea remained NOT GUILTY.
Reddington did say something potentially confusing in explaining the stipulation:
“We have not been contesting the government’s case in chief, if you will.”
But that's an attorney explaining what evidence the defense was choosing not to contest; it isn't Lindsay changing her plea or legally admitting guilt.

This is the BEST break down I’ve seen yet. I’m sick of people saying “but she confessed,” “but her lawyer said she didn’t it,” “this is only to determine if she was insane or not,” blah blah blah blah. The state STILL has to prove it beyond a reasonable doubt, and my gosh there’s so much doubt it’s not even funny.
