THE MADLANGA COMMISSION TODAY: WHEN DUE PROCESS, POWER AND ACCOUNTABILITY COLLIDE Today's proceedings at the Madlanga Commission of Inquiry — 24 August 2026 — offered South Africans another fascinating lesson in governance, accountability and the importance of testing evidence rather than simply accepting competing narratives. Vusimuzi "Cat" Matlala returned to the Commission today for the continuation of his testimony. His appearance had already been delayed from last week to allow further consultation with his legal team and the preparation of supplementary material. citeturn0news9turn0news21 But almost immediately, today's proceedings became about something much bigger than the evidence itself: Who determines when a witness must answer? Where does the constitutional protection against self-incrimination begin and end? How much accommodation should a Commission provide before legitimate procedural protections risk becoming procedural obstruction? And perhaps most importantly: How does an institution remain fair without surrendering control of its own process? Matlala's legal team sought another postponement after his lead counsel, Advocate Anneline van den Heever, was reportedly unable to attend because of illness. Advocate Fatima Missi argued that it would be unfair for the proceedings to continue without Matlala's lead counsel and sought a stand-down until Tuesday so that the legal team could consult and prepare properly. citeturn0news35turn0news18 The Commission refused the postponement application. In fact, reports indicate that two attempts to secure a postponement were unsuccessful, with the Commission requiring Matlala's testimony to continue. citeturn0search33 And that is where today's proceedings became particularly interesting from a governance perspective. Matlala reportedly indicated that he was not prepared to undergo questioning without his lead counsel and argued that additional preparation time was required. His legal team went so far as to raise the possibility of approaching the High Court to prevent the testimony from proceeding. citeturn0search31 Think about that for a moment. A Commission established to investigate allegations of criminality, political interference and corruption within South Africa's criminal justice system is itself being required to navigate an extraordinarily delicate balance between constitutional protection and institutional authority. Neither can simply be ignored. A witness appearing before a Commission does not surrender constitutional rights merely because the questions are important. But equally, a Commission cannot function effectively if every difficult question can indefinitely be avoided through procedural manoeuvring. That tension has become particularly significant in Matlala's evidence. Last week, reports indicated that he declined to answer numerous questions because of concerns that his answers could incriminate him in pending criminal proceedings relating to the SAPS healthcare tender. citeturn0news21 Today he was expected, among other things, to address omissions from his earlier affidavit, including matters involving senior police officials. citeturn0news24 And this is precisely why South Africans should watch these proceedings carefully. Not because a Commission of Inquiry should become entertainment. Not because every allegation should automatically be believed. And certainly not because appearing before a Commission makes anyone guilty. But because accountability requires questions to be answered — and fairness requires those questions to be asked lawfully. That distinction matters. Today's proceedings demonstrate something that every board, executive committee, regulator and public institution should understand: Due process is not the enemy of accountability. Due process is what gives accountability legitimacy. But due process must equally never become a convenient shield against accountability. There is an enormous difference between exercising a constitutional right and
