Earnest money, inspections, repair negotiations and financing contingencies can all create situations where a buyer may be able to terminate and potentially receive their earnest money back. In NC it favors the seller. Homes a as is. Buyers have to pay a due diligence fee to the seller ( normally 1%) that they don’t get back if they decide not to buy the house.

It’s not refundable if they agree to the inspection agreement. The seller determines what that inspection period is and contingencies associated with it. It’s a contract- I’m in Oregon. If a seller wants non refundable it’s up to the sellers and I think this is going to come back into the inspection periods - as this was always present during my past development in the 90’s in sales if properties lots and new builds.

The contract is written for neither. It’s a huge hassle and lawyer investment to get a “small” amount of $ back. Just walk away.
