Red knew he wouldn’t be granted a mistrial he’s protecting the record just incase she’s convicted, appeal attorneys can use this

a thought.... red doesn't exactly want a mistrial (he doesn't want her to do this again for sure) but he wanted it noted how terrible this is going. he wants to bring it up again. or if he doesn't get the ruling he wants.....

So if Lindsey is found guilty and not found insane ( sorry if my wording is wrong on this) could he use this for an appeal?

It’s gonna be an appeal if she’s convicted and if they find intentional prosecutorial misconduct they can’t try her again.

another example of how corrupt Massachusetts really is. I live here and have witnessed first hand. where are the checks and balances...in the pockets of the rich and connected.

I do fear that we will have a hung jury.

at the very least it is definitely something that they can put an appeal in if they find her guilty without insanity.

The judge was not happy at all!!!!! This is not the last we have heard of this from Big Red!! It’s like the prosecution is trying to throw the case! They are ridiculous!!

I keep praying that the jury sees how biased & wildly inappropriate bow b’s have been. Being honest: I’d dread a mistrial for Lindsey and her poor family. Her parents! But, it’s a good point that all of this may be brought up, maybe grant an appeal if we don’t get the result we want. I can’t even imagine how much worse the Patrick did it PPL would be– if even possible

It’s def grounds for an appeal if things don’t turn out how defense is wanting. Rightly so!

Can you explain to me why it’s not allowed? I’m very neutral and found that part compelling. I think I’m confused why it’s allowed in other trials like murder for hate crimes or religious psychosis. I’m confused why it’s not allowed if the crux of this is the comment “go to god baby”. I think it factors into her motive and why I believe she thought she was helping them, like Dr Reznik said? Why was the chaplain allowed to testify about theology but the expert not allowed to include it in his diagnosis?

Why would the prosecutors say that? Wouldn’t they anticipate that it will used against them ?

I disagree. I don’t think it’ll get an appeal. The first time he didn’t request a retrial. And the reason he didn’t is because things were going well for him at that time. The only reason he requested a mistrial today is because there was an excellent expert witness on the stand. If it’s such a big deal then he should’ve been told not to ask Lindsay anything related to religion. He was discussing what he discussed with her-which is his job.

But religion was at the centre of her reason for killing her children & attempting to take her own life. By her own admission? It has to be bought up. It’s proper that it gets bought up. Regardless of how uncomfortable it may be. That WAS her ideation at the time & the reason she murdered her children, she thought she was ‘saving’ them. And she thought she alleviating her suffering & was saving herself, by killing herself. 🤷🏽♀️religious ideation is actually very common in people with psychosis.
