At what point does refusing to grant a mistrial become an abuse of discretion? The jury has now been exposed to the same “mortal sin” issue TWICE. Striking it and telling them to disregard it doesn’t erase what they already heard. You cannot keep ringing the bell and expecting the jury to unhear it. We need to start holding judge Sullivan accountable too. This is an abuse of discretion.
