@prosecutorspod: The Commonwealth called Dr. Kirk Heilbrun as its second rebuttal witness, but on Lindsay Clancy’s diagnosis, he did not agree with Dr. Avram Mack. Heilbrun testified that he diagnosed Clancy with Bipolar II disorder. That conflicts with Mack, who diagnosed major depressive disorder and said he found no mania or hypomania supporting a bipolar diagnosis. Heilbrun acknowledged that he struggled to identify a qualifying elevated mood episode in Clancy’s history. However, he said her diagnosis and treatment at Tewksbury Hospital, along with what he described as an immediate response when a mood stabilizer was stopped, helped support his conclusion. He also distinguished the intrusive thoughts Clancy reported before January 24 from the alleged command voice she later reported during the killings. It is a significant split within the Commonwealth’s own rebuttal case, but a Bipolar II diagnosis does not, by itself, resolve criminal responsibility.
