@attorneystara: The prosecutor in the #lindsayclancy trial goes there again with mortal sin, causing Kevin Reddington to move for a mistrial with prejudice. Judge says no? Was he right? Does it even matter anymore? This is a mess #lawyersoftiktok
He was their most credible expert up till that mortal sin comment.

My thinking was, if the point is that in the catholic way of thinking is that Lindsay wouldn’t have been in heaven with her babies because it’s a mortal sin, wouldn’t that also show that she was delusional and wasn’t thinking about it being morally wrong? 🧐

The way the pauses were, the big sigh before, him not wanting go over a slide, and the way it was phrased very much gave to me that it was a semi coached response they had prepped before. It didn't feel accidental to me at all, but ruling arnt based on feelings 🤷🏻♀️

Am I missing something because I feel like he said multiple times that she made a very serious attempt on her own life... which contradicts what the prosecution was alluding to earlier?

In his testimony he said “she didn’t remember it she was informed of it” that stuck in my head. It has to be some kind of malpractice to ask her if she was a catholic and to ask her if it was a mortal sin when she is on a 1 to 1 already.

I am so glad no mistrial. I can’t imagine him wanting to put Lindsay through this again but I knew there had to a be a reason he made the motion.

The fact that her actions were contradicting her own beliefs would prove she was in a psychosis, also what value does it have 3years later, can she actually remember her thoughts at that moment? Or is it the sense she has made out of it after 3 years of therapy

Wasn’t this the “slide” that he wanted to skip anyway? And she continued with it?

It’s like the witness really didn’t want to finish his thought with that sentence… He really drug it out and it seems like he didn’t want to say it at all… But the prosecution just had him keep talking

The church recognizes severe, psychological distress can diminish free will. You don’t go to Hell. Catholic here🙋🏼♀️This has been since the 90’s.

I thought he was good until he based a large part of his opinion off of what PC said she said as she was laying half dead on the ground. Then that happened and I no longer believe anything he said.

I think the Dr tried to pass over that slide but the ADA had him go over it anyway. She definitely wanted him to go over that.

As someone who has worked with psychosis, they often display religious fevor or have elements of religion. Attempting to argue the "religious morality" is just stupid. It doesnt proof she wasnt in psychosis. It actually helps support imo.

I think if the bow ladies hasn’t brought it up before, this would not have been an issue. But because they did, Redd had enough. I think this goes more to the prosecutions inability to adequately prep witnesses than anything else at this point.

No, I’m sorry. Based on his deep breath and sigh and weird phraseology (Catholic considerations?) he was definitely aware that if he mentioned “mortal sin” that it was gonna set something off . He literally seemed almost AFRAID to say it because he knew it was gonna be disruptive in some way. The prosecutor ABSOLUTELY coached him to say that.

my biggest question is: if the expert witness has doubts about what happened and proposed two possible explanations: one is psychosis and another a "need to control" the situation with her kids after her suicide, would that not be reasonable doubt to begin? Like how can you ask the jury for a definitive answer when even he can't give it?

I think it’s wild that they keep approaching this because psychosis often has religious overtones and it would seem to go to the defense’s argument that she was not in a state to appreciate that it was morally wrong in the moment.

Catholic dogma has been updated to reflect the role of suffering with mental health issue in suicide. They are way more lenient than you are directly going to hell. And my other point is that didn’t they say that she went to church like once or twice a year before? It seems like since this happened she is more connected with the Catholic Church than she ever did in her entire life.

I mean I get she’s catholic but I am also raised catholic, went to catholic school for 9 years, CCD classes and made my confirmation and had my children baptized in the Catholic Church and i have never had the thought of mortal sins cross my mind when thinking about murder ever. So I find it hard to believe the concept of mortal sins crossed her mind ever whether she was lucid or not during all of this. Unless she’s known to be a super devout catholic woman who really loves her religion and follows it to a T.

Ok but if she truly knew murder or suicide were a mortal sin, but on Jan 24th she believed that she could kill the kids, kill herself and then they’d all go to God, wouldn’t it also be possible (within reasonable doubt) to say that she lost touch with reality that day and no longer had the ability to know that was morally wrong because if so she wouldn’t have done it (premeditatedly).

to me this argument doesn’t go anywhere unless we know how lindsay saw god or her own religion. if i asked my very catholic grandma if god would allow someone who committed suicide into heaven she would 100% say something like ‘god would never refuse someone in pain’ but i know religion is very different in the states so maybe that works for the jurors present!!

This was their BEST witness BY FAR. He was clear, calm, easy to understand, had a freaking power point!! I was really interested in his testimony and thought he sounded credible/neutral...until he wasn't. 🤦🏼♀️their best witness and they STILL managed to f*ck it up. Crazy work.
