But at this point the prosecution, and their witness has now thrown around religion and whether you tell the jury to “disregard” it or not they cannot unhear it and that’s why it’s usually grounds for a mistrial every time and now allowed in court! Because those types of things play on jurors emotions and their religious emotions and the prosecution knows that and could hear that man speaking, knew where he was going with that and had time to stop it before it was said and she didn’t which is why Red said it was intentional misconduct because even after being “forgiven” by Red the first time she allowed it to happen again! 100% mistrial should have been granted. Again you can ask them to disregard it all you want but what you can’t do is make them unhear it!
