Good and evil, right and wrong are social constructs. As we evolved as increasingly complex social beings, we developed codes of conduct to allow social harmony and cohesion. Morality is a social construct that allows to live in society, just like money, nation states, religion... these are fabricated fictions.

Empathy and intelligence as words don’t serve as a basis for why harm is bad. You have to actually construct an argument. Something being good or bad isn’t enough to give good actions normativity. You have to convince the agent why an action being good means they must do it and an action being bad means they shouldn’t do it. Doing x makes me a bad person? Why should I care to be a good person? When you end at « my empathy and intelligence » it’s not going to genuinely convince the person you’re arguing with because that reduces morality to the subjective, and at that point, you have no moral leg to stand on. When responding to the question of murderers etc, if you appeal to the golden rule, that doesn’t really do anything for you if morality is just this vague « empathy and intelligence ». You need to make an argument for why someone should treat the golden rule as a maxim with normativity. You have to flush it out or your argument is totally empty. Also saying that you « understand » x to be wrong implies that x is wrong, which is either an objective fact or it’s not. Unless by understand you literally mean « it’s my personal subjective opinion that x is wrong and anyone else’s opinion is just as valid ». In that case, there is no point to talk about morality or what anyone should do besides trying to impose your power on the world to advance your personal interests.

If an animal plays too rough with another animal in its pack or herd and they hurt them, they stop playing and lick or caress the area that was injured. An animal has absolutely no idea the bible exists yet it was able to determine that the actions it committed were wrong and needed to stop - that is empathy and mental intelligence, not related to any form of religion.
