Judges have become so accustomed to report language being valid on its face for so long. However an evolving trend is for judges to see body cam footage that is clearly different than written reports. Drivers being "uncooperative", "aggressive" etc. who are actually asserting their rights. The system really needs to Reassess the language used by cops in reports compared to body cams. You'd be surprised that you're really NOT seeing what's written in a report. All this to say, if you can call the officer's credibility into question in other aspects of the written report, a claim of odor where no odor could be present might be easier to sell to a judge.

it's simple, don't smoke Marijuana before you drive, that smell lingers, it doesn't need fixed, it's no different than the odor of alcohol

Even if it’s legal in certain states it’s still not legal to drive while impaired or smoke it while operating a vehicle, so smoke it at home and don’t get behind the wheel after!
