Sushi fish in the US is so highly controlled, it is incredibly unlikely youll get sick as long as you have a reputable restaurant. So unless you eat enough to get like mercury poisoned, the restaurant was probably soing something wrong and should be held liable. You're more likely to get sick from the rice than the fish.

Let me reframe this. Yes you can see for absolutely anything. If a business like a restaurant gives you a disclaimer by eating there you are taking on what’s legally known as assumption of risk therefore, you will lose the case because you knew there was war fish you knew raw fish could have you food poisoning and you still ate it therefore, no judge is going to decide with you. You can sue for absolutely anything. The difference is you’re not gonna always win and 90% of the time you’re not because 90% of the time it’s your fault because you chose to ignore warnings and disclaimers
