At what point does a child welfare system examine whether its own failures helped make a tragedy possible? Because Maine has some explaining to do. On October 9, Robert McCoy, 37, was sentenced to 17 years in prison, with nine suspended, after pleading guilty to manslaughter in the death of four-year-old Jasper Smith. Eight years behind bars. Six years of probation. Jasper died in May 2025 after finding a loaded handgun inside his family’s Lewiston apartment and accidentally shooting himself. Prosecutors say the gun was stored in a zipped bag near a bassinet. A loaded firearm. In a bag. Within reach of young children. Apparently, the safety plan was a zipper. McCoy apologized during sentencing. The criminal justice system has imposed its punishment. But the child welfare system? We need to talk about that. Jasper’s relatives say Maine’s Department of Health and Human Services received 17 reports of concern, leading to seven child protection investigations. None reportedly produced substantiated findings. Seventeen reports. Seven investigations. A child who never reached his fifth birthday. Those numbers come from family accounts, not independently released DHHS records. We cannot yet establish what each report alleged or whether investigators followed the law. But we can demand an independent examination. WHY WE’RE WATCHING: An unsubstantiated finding does not automatically mean a child was safe. It means the agency did not substantiate the allegations under its standards. Those are not interchangeable conclusions. If the family’s account is accurate, Maine must explain how repeated warnings were evaluated, what risks were identified and whether opportunities for intervention were missed. McCoy has been sentenced. Now comes the part government agencies tend to find less appealing: accountability for their own decisions.
