Hi it's me again. 👋🏼 😭 Well about recordings holding up in court, I have prior commented about an employment suit I filed, and SOME of my evidences was indeed audio recordings, and they DID hold up as evidence.😅... Mine were taken SOLELY during convos related to the issue I had, and NEVER EVER included company proprietary info or PPI. Ohio is a one party state, so you can privately record as long as you are part of the conversation. It sounds like Texas is as well, granted of course there's nuance... but that's how mine in Ohio worked out. 🤷🏼‍♀️

Straight up, we had to put no covert recording in our code of conduct to be clear that permission always had to be sought. It can be very unfair when only one party to a conversation knows that recording is occurring.

From someone who has a child with a learning disability, he records everything because it’s easier than taking notes. So please also ask if it’s an accommodation.

Anecdotally, I have ADHD and record any conversation I can. I ask for consent/let them know every time, but could this be the reason? Are there accommodations for this if disclosed earlier?

With the rise of Meta glasses I asked HR what our policy is surrounding recoding in stores. And if there is none yet will there be a policy put in place they told me no you as in the sales manager have to deal with it case by case and we can partner with them. Why do companies wait until there is a huge issue to deal with things like this?!

this is actually making me feel really relieved. I started recording convos w my manager a few months ago because she was toeing the line of acting retaliatory toward me when I applied for a new job internally and I wanted proof. she also doesn’t take notes and changes her mind on projects every other meeting which is so hard for someone neurospicy to keep up with! I’ve been feeling bad about it but honestly less so after watching this? plus I delete the recordings as soon as I finalize my notes and I definitely do NOT keep them on my work computer

Honestly- being from and living in Texas- yeah those convos that are recorded can be admissible depending on the circumstances. It’s a company computer and therefore the property of the company since they were recorded on there but like my thought process to just be sure everything is kosher and to figure out what’s going on in them is to have legal or a third party review them up to this point and give a general description of them. Inform the employee of the new policy and ask what the recordings may be about and if there is some resource she may need (such as turning someone in for some type of harassment or maybe she needs a voice to text device for hard of hearing, etc). After that let her go, tell the manager not to utter a word about it, and just watch her for a little while to see if she does anything sketchy or if she does need help.

Yeah there are a few good reasons why the employee might be recording and a lot of sketchy reasons. 😬😬😬 Can’t wait to hear the convo with the employee. (And I hope the manager is also doing the right thing w/ not listening and not bringing it up)

I used to record every meeting because 90% of our jobs were grant driven & it gave me detailed information for reporting on the grants. But I always announced at the beginning of those meeting that I would be recording & why

I record all teams professional development conversations and meetings, it should be assumed everything is recorded. The PD is for my records but the meetings I'm responsible for dictating notes and sending recap emails.
