We are watching legal immigration pathways get shut down through something much harder to challenge immediately: the “temporary pause.” Look at the pattern. Diversity Visa issuances have been paused since December, and DV-2026 winners have until September 30 to receive their visas or lose that opportunity. Then the administration paused immigrant visas for people from 75 countries in January. Seven months later, a federal judge ruled that policy unlawful and said Secretary of State Marco Rubio had exceeded his authority. Now, just days after that ruling, immigrant visa interviews are being paused worldwide while the State Department retrains officers on public charge. To be completely accurate, the government says that training initiative began earlier this month, so I cannot prove this new pause was created in response to the court ruling. But the broader pattern deserves scrutiny. A legal immigration pathway gets blocked, the policy ends up in court, and when one mechanism fails, another restriction appears. We are seeing a similar fight with H-1B visas, where a judge struck down the administration’s $100,000 fee and the government has now proposed a new $103,265 fee through a different process. Is this new worldwide interview pause already illegal? I can’t honestly say that yet.
